trend.: OGH: U-turn on indexation clauses in lease agreements

The Austrian Supreme Court (OGH) has changed its case law on indexation clauses in lease agreements, providing important clarification for landlords.

  • Indexation clauses are valid even if they do not explicitly exclude a rent adjustment during the first two months (§ 6 para 2 no 4 KSchG).
  • If the tenant pays the indexed rent without objection for one year, this constitutes implied consent to the agreed base index.
  • The ruling provides greater legal certainty for landlords and clearer guidance for contract drafting.
